Prices quoted on this website replace all previous quotes and are subject to change without notice.

Terms of Sale

All sales are F.O.B. or C.O.D. All trees accepted by customers or employees must be paid in full. We reserve the right to cancel any part or all of any order in the event of crop loss, damage, or shortages. All orders are subject to government regulations, weather, and all conditions beyond our reasonable control. We reserve the right to request a 50% deposit on any order before digging.

Guarantee & Claims

If any nursery stock is proven to be untrue to name, we will replace such material or refund the amount paid. Claims for any cause must be made promptly upon receipt of plant material. We will not entertain claims after trees have been accepted. Our liability does not exceed the dollar amount received by us for plants in question. We do not guarantee nursery stock since we cannot control unloading, handling, planting, soil, weather, or maintenance of trees. We will not replace plants that fail to live or thrive. No warranty is given, expressed or implied, as to the growth of our nursery stock after you receive it. We are wholesale growers and as such we do not price in the cost of a replacement guarantee as a retailer or landscaper does.

Order Cancellations

We must receive any cancellation request in reasonable time before the expected digging date. If you cancel your order of any plant material already dug, you are responsible for its total value and you will be billed accordingly.

Pickup & Delivery Terms

Plants become your property upon delivery to the transportation company and we cannot be responsible for loss, damage, or delay in transit. We will not be responsible for the condition of plants that are not picked up within seven days of customer notification that the order is ready. Customer owned trucks need to supply adequate tree support at the rear of the truck or trailer, proper strapping and suitable tarp to protect trees during transit.

Agreement

All orders are taken and trees are sold with the distinct understanding that the purchaser agrees to the conditions of sale as stated above.
